Recently, the Supreme Court observed that judges should avoid making unnecessary remarks on the conduct of counsels that might have no bearing on adjudication of the dispute.

The observation was made by a Bench of Hon’ble Justice Hrishikesh Roy and Hon’ble Justice RF Nariman while ordering expunction of some remarks made against an advocate by the Uttarakhand HC in an order that it passed.

The lawyer, who has been practising for 17 years, approached the Supreme Court seeking expunction of certain remarks that a judge made against him in a judgement. He argued that he should not be made to suffer adverse remarks on his conduct just because the Judge did not appreciate his efforts.
